Aotearoa-New Zealand endorses UN Declaration on the Rights of Indigenous Peoples

National has bowed to Maori Party wishes and agreed to support the highly contentious United Nations Declaration on the Rights of Indigenous Peoples despite the previous Labour Government issuing dire warnings that the document is fundamentally incompatible with New Zealand’s constitutional and legal systems.
New Zealand’s support for the declaration was conveyed in a speech early today by Maori Affairs Minister Pita Sharples at the United Nations in New York.
The declaration recognises the rights of indigenous peoples to self-determination, being able to maintain their own languages, being able to protect their natural and cultural heritage and manage their own affairs.”

Secret anthropology reports, masks of respectability – the NLC and the uranium industry, Muckaty

According to one newspaper report i was reading regarding the consent of some of the traditional owners of Muckaty (NT) the Northern Land Council (long in the pocket of the uranium industry) is relying on an anthropological reports to support their position vis-a-vis a possible radioactive dump at Muchaty:
“Ron Levy, the NLC’s senior legal counsel, insisted there was overwhelming support for the dump from Ngapa people with the authority to make decisions regarding the land, based on the still-secret findings of three NLC-employed anthropologists.”
In the (unproofed) transcript the recent sitting in Darwin of the Senate Legal and Constitutional Affairs Legislation Committee, i was surprised to read:
Senator LUDLAM—It sounds to me as though a number of different people and different groups have obligations that are around that area and on that area. The Northern Land Council has a legal obligation to talk to not just one group of people but to talk to a range of people. Unfortunately we have not seen the agreement that was signed because it was secret, and we have not seen the anthropological study that was done because that is secret as well.
And in a letter read to the Senate Inquiry from First Peoples with afflialiations with the Muckaty area:
“Any land claim under the Northern Territory lands act is commonly owned and is freehold. How, then, was it possible to sell part of our claim? Who was consulted? Who sold the land and who bought it?  How much money changed hands and who were the beneficiaries? We never heard that a land claim can be lodged by one single family group, like the Ngapas have done. Our traditional country holds many  different dreamings. We inherited countries through father and mother. These are known as kirta kurtungurlu family relationships among our people. We are demanding to see the anthropologists’ evidence provided to the Northern Land Council regarding Ngapa clan.” (emphasis added – BR)

a. Anthropologists should not communicate findings secretly to some and withhold them from others.
g. In accordance with the Association’s general position on clandestine and secret research, no reports should be provided to sponsors that are not also available to the general public and, where practicable, to the population studied.

Which raises the question – how does the situation at Muckaty relate to any code of ethics for professional anthroplogists in Australia, especially in light of the worldwide push to generate more private profits for those in the uranium industry?

This needs to be sorted out before the next move by the uranium industry – to store used radioactive waste from uranium mined in Australia and sold overseas.

Commission President Cathy Branson QC, launched the new rightsED resource this week by sending a complimentary DVD to schools around the country in a bid to help students develop a critical understanding of human rights and responsibilities.
“The importance of human rights education should not be underestimated in our efforts to create a more respectful human rights culture in Australia,” Ms Branson said.
“Human rights education is critical if we are to make real inroads in our efforts towards true social inclusion in Australia. “I urge all teachers to take advantage of these practical tools that will bring human rights to life for students around Australia.”

Muckaty radioactive waste plan must be dumped: Greens

The Federal Government has no alternative but to scrap the nomination of Muckaty Station, near Tennant Creek, as a site for Australia’s first ever radioactive waste dump following evidence heard at a Senate inquiry in Darwin, according to the Australian Greens.

“Today we heard first hand accounts of just how flawed the process was that led to Muckaty’s nomination,” said Senate Committee Member Greens Senator Scott Ludlam.

“Numerous Traditional Owners outlined how they and their people were completely excluded from the shared decision making process which is the norm in Aboriginal custom on issues to do with kinship of land.

“Despite claims to the contrary, it is clear they were not properly consulted and have never given consent – a fact human rights lawyers recently confirmed as they assess avenues for a possible legal challenge.

“From all I have heard and read in this inquiry from over 230 submissions, the only outcome is for Muckaty to be scrapped and a fresh process begun that is truly consultative, transparent, scientific, and accountable, as this government promised.

“Labor must now do the right thing by the people of the Northern Territory, not to mention avoid the possibility of an embarrassing, protracted legal battle,” Senator Ludlam said.

Tibet earthquake appeal – support and compassion required

Dear Friends,

As you may have already heard, a strong earthquake measuring 6.9 magnitude has struck the Tibetan area of Kyigudo area of the Amdo Province of Tibet, (Chinese: Yushu Tibetan Autonomous Prefecture of Qinghai Province) with the epicentre at Kyigudo city in what China refers to as Jiaku.

The quake struck early on Wednesday morning, devastating up to 85 percent of the mud and wood houses, monasteries, hospitals, schools along with power and water infrastructure in the region.

The latest reports indicate that up to 800 people have lost their lives and many thousands are injured. However, unconfirmed sources including those from Tibetans living in exile, originally from the quake hit area who have managed to communicate with family within the region, place these numbers much higher.

One Tibetan who said he spoke to someone in his village puts the death toll around 3000. There are still many buried under rubble with rescue efforts hinder by the lack of rescue equipment. Survivors and Chinese soldiers are trying to pull them out with human labour only. Reports are that the Chinese government have sent in teams and equipment to assist with the rescue efforts along with blankets and tents as the overnight temperatures are near freezing.
His Holiness has offered prayers for the victims of the earthquake, saying from Dharamsala in India, ‘I am deeply saddened by the loss of life and property as a result of the earthquake that struck Kyigudo this morning. We pray for those who have lost their lives in this tragedy and their families and others who have been affected.

It is my hope that all possible assistance and relief work will reach these people. I am also exploring how I too can contribute to these efforts’.

His Holiness’ representative here in Australia Mr Sonam Dagpo, said from his office in Canberra, ‘I feel very sad on the loss of lives and sufferings of the living. I offer my heartfelt condolences to the families who lost their lives’.

The Tibetan Information Office and Dalai Lama in Australia are deeply saddened by the devastation and loss of life and have organised with Global Development Group, an Australian based aid agency, to launch an appeal to direct aid to the victims urgently in need of assistance. The Global Development Fund is a charity organisation carrying out humanitarian projects with approved partners around the world.

Rob Keldoulis, the Chairman of DLIA, said today, ‘the need for quick action is most pressing. Natural disasters such as this are a tragedy wherever they occur, but as supporters of His Holiness and the Tibetan people, this particular one strikes very close to home’.

Your help is most urgently needed for those affected in the region, the overwhelming majority of them being Tibetans. Whatever support you can give towards immediate assistance for medicine, clothing and food, and also long-term support for rebuilding schools and health clinics, would be very much appreciated.
Please, we urgently request your help in assisting the Tibetans in the Kyigudo area who have been affected by this devastating earthquake.  We assure you that whatever amount you can offer, however large or small, will go directly to assisting the people in the area.
